Assault Crimes

In Illinois, the law divides sexual assault into four basic crimes:

Criminal Sexual Abuse

Aggravated Criminal Sexual Abuse

Criminal Sexual Assault

Aggravated Criminal Sexual Assault

For all four crimes, the behavior has to be non-consensual and accompanied by force or threat of force. Threat of force includes threats to harm the victim, family, significant others, suspicion of a concealed weapon, physical size difference, etc. Consent must be freely given.

Sexual Abuse is the use of force, or threat of force, when fondling or touching the victim's sex organs, anus or breasts -- or any body part of a child under 13 -- for the purpose of sexual gratification or arousal of the victim or the offender. 

Sexual Assault is committed when there is any contact, however slight, of the offender's sex organ, mouth or anus, or the intrusion of any body part of the offender, animal, or object into the sex organ or anus of another person.  These crimes are charged as "aggravated" if they include a display or use of a weapon, if great bodily harm has occurred, if the victim is over 60 or under 13 years of age, or the victim is handicapped.

Sexual Harassment is defined as unwanted, deliberate or repeated sexual behavior, including comments, gestures or touching. The person hearing, seeing or being touched does not want this attention and is frequently uncomfortable and embarrassed.  It can also be unlawful sex discrimination if there is a subtle or direct threat that a sexual or social relationship is part of your job or your educational performance.  The threat can be about any part of your job -- salary, promotion, references, working conditions -- or about your educational performance including grades, honors, coursework and scholarships. 

A person commits Domestic Battery if he intentionally or knowingly without legal justification causes bodily harm to any family or household member or makes physical contact of an insulting or provoking nature with any family member or household member.
